How to Enter
- From November 3rd through November 27th send us your favorite picture (up to three per day), in its original version, to contest@selectitaly.com. In the body of the email include a title for each photo and the location where it was taken, along with your full name, address, birth date and a daytime phone number that can be used to contact the winner. To participate you must be 18-years old or older and a legal resident s of the United States, the District of Columbia or Canada. Please read the Official Rules of the Select Italy Photo Contest.

SELECT ITALY “PHOTO CONTEST” COMPLETE OFFICIAL RULES
1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Open only to legal residents of the fifty United States and the District of Columbia. Entrants must be at least 18 years of age or older at time of entry. If 18 is not the age of majority in the jurisdiction in which entrant resides, entrant will need to obtain permission from their parent/legal guardian in order to enter and be declared a winner. Void where prohibited. Contest begins at or about 12:00:01 a.m. Central Time (CT) on November 5, 2001 and ends at 11:59:59 p.m. CT on November 27, 2011. All entries must be received by 11:59:59 p.m. CT on November 27, 2011 (the “Entry Deadline”). Entry requires Internet email access. Limit of one entry per person or email address. You may enter the promotion under one name/e-mail address only. Employees of Ars & Civitas, Inc. DBA Select Italy (“Sponsor”), its subsidiaries, affiliates, advertising and promotion agencies, retailers and distributors (collectively with Sponsor, “Contest Entities”), and such employees’ immediate families (i.e., parents, spouse, children, siblings, grandparents, step parents, step children and step siblings) are not eligible to enter this Contest.
2. HOW TO ENTER. Enter the contest by emailing a maximum of three (3) digital photos taken in Italy or Croatia to contest@selectitaly.com, along with the following information: full name; complete address [no P.O. Boxes]; birth date; daytime phone number, including area code; email address; and where the photo was taken. The name of the authorized account holder associated with any given e-mail address will be deemed to be the entrant and must comply with these Complete Official Rules. The authorized account holder is defined as the natural person who is assigned an email address by an Internet-access provider, online-service provider, or another organization that is responsible for assigning email addresses or the domain associated with the submitted email address. No software-generated, robotic, programmed, script, macro or other automated online entries are permitted. Multiple entries per person/email address are prohibited and will void all entries by that entrant. Entrants assume all risk of lost, late, misdirected, incomplete, or illegible entries.
3. PHOTO RULES. By submitting one or more photographs, each entrant represents and warrants that he or she is the photographer of all Photos he or she submits, that he or she has permission to publish the likeness of any and all persons depicted in the Photos, and that the Photos do not infringe any copyright or other intellectual property right of any other person. Sponsor reserves the right to disqualify any Photo that, in Sponsor’s sole determination: does not depict Italy or Croatia; contains defamatory, vulgar, obscene, libelous, hateful, or racially, ethnically or otherwise objectionable language or imagery; violates the privacy of any individual; disparages or otherwise refers to any company or product; or infringes any intellectual property right of any person or company. Photos submitted properly and in accordance with all instructions and these Complete Official Rules, and not disqualified by Sponsor, are referred to as “Eligible Photos.” Each entrant retains ownership of the Photos and the intellectual property rights therein. However, each entrant hereby grants to the Contest Entities a perpetual, fully-paid, royalty-free, irrevocable, non-exclusive license to publish, reproduce, prepare derivative works of, distribute, display, exhibit, transmit, broadcast, televise, digitize, otherwise use, and permit others to use and perform throughout the world the entrant’s Photos in any manner, form, or format now or hereinafter created, including on the Internet, and for any purpose, including, but not limited to, advertising or promotion of Contest Entities, regardless of whether the Photos win the Contest or not. Sponsor has no obligation to post or publish any Photo submitted. All such postings or publication, if any, will be in Sponsor’s sole discretion and the posting or publication of a Photo does not guarantee the Photo will be selected as a winner.
4. VOTING PERIOD. Promptly after the Entry Deadline, and no later than [November 27], 2011, Sponsor will post all Eligible Photos to an album entitled “[Memories] Photo Contest” on Sponsor’s Facebook page. Each Eligible Photo posted is referred to as a “Posted Photo.” Entrants are encouraged to share the Facebook links to their Posted Photos with their friends and families and invite them to “Like” the Posted Photos between November 28, 2011 and December 18, 2011 (the “Voting Period”). On or about December 18, 2011, Sponsor will tabulate the “Likes” for all Posted Photos and will determine which Posted Photo received the most “Likes” during the Voting Period. In the event that two or more Posted Photos receive the same number of “Likes” during the Voting Period, a panel of Sponsor personnel (“Panel”) will select the one (1) Posted Photo that the Panel determines best captures the beauty, culture, cuisine, and/or history of Italy or Croatia. The decision of the Panel is final; in the event the Panel cannot agree on a Prize winning Posted Photo, the Prize winner will be chosen randomly from among the tied Posted Photos. Non-winning entrants will not receive any notification of their non-winning status. Winners are subject to verification. Potential winners will be notified by email or other method determined by Sponsor and sent a redemption code or other instructions for Prize claim.
5. PRIZE. The Prize consists of one (1) small Select Italy “Eatalian Style” Gift Basket. Approximate Retail Value of Prize is $159.00.
6. GENERAL CONDITIONS. The Prize winner will be notified by email, U.S. mail, telephone, or private delivery service (at Sponsor’s sole discretion) and may be required to sign and return an Affidavit of Eligibility and Release of Publicity (where permitted by law) and Liability within five (5) days of notification. In the event of noncompliance, if the Prize winner cannot be reached at the phone number, e-mail address, or address on the winner’s entry, or if the Prize or Prize notification is returned as unclaimed or undeliverable for whatever reason beyond the control of Sponsor, the Prize will be forfeited, and an alternate winner will be selected. Depictions of prizes in Contest-related materials are for illustrative purposes only and may not be actual prizes provided. Sponsor is not responsible for invalid or incorrect e-mail addresses. No substitution of any prizes will be offered, except at Sponsor’s sole discretion. No prize transfer is permitted. If a prize is unavailable, Sponsor reserves the sole right to substitute a prize of equal or greater value. Limit of one prize per person/band, mailing address, or e-mail address. All taxes, fees, and surcharges on prizes are the sole responsibility of each prizewinner. By participating and accepting a prize, where permitted by law, the winner grants to Sponsor (and agrees to confirm that grant in writing) and those acting pursuant to the authority of Sponsor, the right to print, publish, broadcast, and use-worldwide in any media now known or hereafter developed, including, but not limited to, the World Wide Web-at any time(s), the winner’s name, portrait, picture, voice, likeness, and biographical information as news or information and for advertising and promotional purposes without additional compensation or review. All interpretations of these Complete Official Rules and decisions by Sponsor are final and binding. Sponsor reserves the right in its sole discretion to disqualify any entrant it suspects or finds: (i) to have used a software-generated, robotic, programmed, script, macro or other automated online entry; (ii) to have tampered with the entry process or the operation of this Contest; (iii) to be acting in violation of these Complete Official Rules; (iv) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; (v) to have submitted a Photo that is not original to the entrant or otherwise infringes any other person’s copyright or other intellectual property right; or (vi) to have provided inaccurate information on any legal documents submitted in connection with this Contest.
CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
7. RELEASE OF LIABILITY. All entrants agree to indemnify, hold harmless and release Sponsor; its affiliates, subsidiaries, and distributors; the service agencies and independent contractors of any of the above organizations; their respective officers, directors, employees, and agents (including advertising and promotion agencies); and all others associated with the development and execution of this Contest from any and all liability with respect to or in any way arising from this Contest, including but not limited to claims arising from a Photo’s infringement of third-party intellectual property rights or violation of third-party privacy or publicity rights; participation in any Contest-related activity; and/or delivery/misdelivery, acceptance, possession, use, or misuse of a prize, including, but not limited to, liability for personal injury, bodily injury (including wrongful death or disability), damage to property, and damage or loss of any other kind. Sponsor does not control and shall have no liability for the use of submitted Photos by third parties after such Photos are posted or published in connection with the Contest or otherwise. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or used in the Contest, or by any technical or human error that might occur in the processing of submissions in the Contest. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications-line failure, theft, destruction, unauthorized access to, or alteration of entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines; providers; computer equipment; or computer software or for failure of text or online entry on account of technical problems or traffic congestion, including injury or damage to the participant’s or to any person’s computer related to or resulting from participating in or downloading materials for or from this Contest. Sponsor is not responsible for user cheating or fraud by any entrants. Any activities intended to disrupt or interfere with the proper administration of the Contest or to defraud Sponsor in any way will be prosecuted to the fullest extent of the law. Participants who engage in any of the foregoing activities will be disqualified and will forfeit any prizes won. Only the number of each prize set forth in these Complete Official Rules will be awarded. If, for any reason, the Contest is not capable of running as planned due to, without limitation, tampering; unauthorized intervention; fraud; technical failures; or any other causes beyond the control of Sponsor that, in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Contest and to select a winner from all eligible entries received as of the date of termination.
8. DISPUTES. THIS CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF ILLINOIS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, each participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a state or federal court located in Cook County, Illinois, having jurisdiction. Each entrant waives any and all objections to jurisdiction and venue in these courts and hereby submits to the jurisdiction of those courts. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for and hereby waives all rights to claim punitive; incidental; or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and participant further waives all rights to have damages multiplied or increased.
